Terms & Conditions

(1.) I reserve the right to refuse and/or cancel a commission at any time for any reason and will provide a full refund if payment has already been provided.

(2.) All prices are in USD, and must be paid in full through PayPal prior to the start of a commission(s). Unless previously discussed and agreed upon by all parties, you will be provided a PayPal invoice and must submit payment through that invoice.

For illustrated work, I accept splitting payments per level of completion. For example; if a sketch is paid for and completed and you want to move on to paying for linework, you would only pay the difference as part of it has already been completed.
Additional fees may be applied if you require the commission to be completed in a short deadline. _[9c]

(3.) All work created is for personal use only unless previously discussed and agreed upon by all parties. Any work created for commercial or public use, or reproduction onto merchandise will incur either a commercial rights or a monetisation fee(s). Commissioners wanting to use work(s) for commercial use, or reproduction onto merchandise will sign a contract with the artist (Jaycen Hill / UltimaDesigns) to formally agree to these terms.

A monetization fee gives you the rights to use the image for use in monetized formats such as youtube or livestreams. (monetization fee = x0.5 of the commissioned work(s). i.e. a $150 commission has a $75 fee, for a total of $225.)
A commercial rights fee gives you rights to use the image for resale; this means you can use it for stickers, shirts, promotional materials, etc. without the artist (Jaycen Hill / UltimaDesigns) receiving any income from sales or other revenue. (Commercial rights fee = x2 the cost of the commissioned work(s). i.e. a $150 commission has a $150 fee, for a total of $300.)
If completed artwork previously commissioned for personal use is wanted for use in commercial use, or reproduction onto merchandise, you may purchase those rights. Please reach out to request a contract and discuss monetisation/commercial rights fees.
Professional works such as advertisements, social media posts, or editorial designs fall under separate guidelines and commission prices and must be negotiated directly via Email ([email protected])

(4.) All works created may NEVER be used for NFTs (non-fungible token). Works(s) also may NEVER be used in AI generation, training, replication, or other AI uses. This is non-negotiable regardless of price.

(5.) I retain the copyright of all images created under Title 17 of the Federal Copyright Act unless otherwise discussed and agreed upon by all parties. This entitles me to display and promote myself using work(s) created.

If you wish for these work(s) to not be shared or displayed such as on social media, including work in progress pictures, please discuss this with me prior to commissioning.
This does not exclude the commissioner(s) from sharing the artwork with appropriate credit and attribution in non-monetized forms.

(6.) Work(s) may be displayed and worked on during live streams on Twitch, or through other streaming services. If you have any reason you do not want the work to be displayed in this way, this must be discussed with me prior to the start of any commissioned work(s).

(7.) Any major changes or revisions after work has been completed may incur a revision fee; pose, outfit design, etc. Minor changes are allowed with no extra cost such as changes to colour. Revision fees will depend on the changes asked for and can be discussed. Progress will be provided as regularly as possible to help prevent major changes occurring without notice.

(8.) For a full refund, commissions must be cancelled prior to any work beginning. No refunds will be given after the work(s) have been completed.

If any work has already been started, partial refunds may be offered depending on the amount of work put into the commission at the time of the refund request.
All refunds will be initiated on the side of the artist. Do not request a PayPal chargeback.
If you request a fraudulent PayPal chargeback you will lose all aforementioned rights to the work(s) created. All fraudulent chargebacks will be denied and PayPal will be supplied with evidence of conversations, proof of work, and these terms and conditions. Furthermore, you will be blacklisted from commissioning me in the future.

(9.) Time frames for completion of the work(s) will be discussed prior to the start of the commission.

Time frames may be subject to change if a deadline was not discussed prior to the start of the commission.
Deadlines for completion must be stated prior to the start of the commission.
Deadlines shorter than 30 days may incur additional fees and can be discussed.

(10.) If at any point the buyer/commissioner/recipient(s) of the work breaks any of these terms and conditions they will lose all aforementioned rights to the work(s) created by me, Jaycen Hill / UltimaDesigns, and I will have the right to profit further from the commissioned work, and/or may seek compensation. Any questions or problems with the clauses stated within these terms and conditions must be discussed with me by the commissioner(s) prior to paying for any commissioned work(s).
